Terms of Service

These Terms of Service (“Terms”) are a contract between you — the individual or organisation using the service — and Moneko (“Moneko”, “we”, “us”). They govern your use of the Moneko application at https://moneko.app, its API, and this website (together, the “Service”). By creating an account, joining a dataspace or using an API key you accept these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it.

Moneko lets you store resumes and candidate data in a shared workspace (a “dataspace”), parses them with AI, and lets you search, rank and assess candidates against a vacancy or requirements you provide. We may add, change or remove features over time; we will not materially reduce the core functionality of a paid plan during a paid period without notice.

• You must provide accurate account information and keep your sign-in method secure. You are responsible for activity under your account.
• A dataspace belongs to the organisation that created it. Dataspace admins control membership, roles and API keys and can delete the dataspace and all its content.
• API keys grant access to a dataspace without a user session. Keep them secret; disable or delete a key immediately if it may have been exposed.

Resumes, candidate records, tags, notes, queries and anything else you or your team upload or create (“Customer Content”) remain yours. You grant Moneko a limited licence to host, process, convert, index and display Customer Content solely to provide the Service to you and as described in our Privacy Policy.

You represent and warrant that:

• you have a lawful basis — and, where required, the candidates’ consent or notice — to upload and process each resume and the personal data it contains;
• you will handle candidates’ rights requests (access, correction, deletion) and delete candidate data when you no longer have a basis to keep it;
• Customer Content does not infringe anyone’s rights or violate applicable law.

Where data protection law applies, you are the controller of candidate data and Moneko is your processor; our data processing agreement is available on request.

You agree not to:

• upload resumes or personal data you are not entitled to process, or data obtained by scraping, purchase or other unlawful means;
• use the Service to make hiring or other decisions in a way that discriminates unlawfully or that treats AI output as the sole basis for a decision with legal or similarly significant effects on a person;
• resell, sublicense or provide the Service to third parties as a bureau service without our written agreement;
• attempt to access other customers’ dataspaces, probe or circumvent security, or place unreasonable load on the Service (including through the API);
• reverse engineer the Service, or use its output to build a competing AI recruiting product.

Parsed fields, keywords, summaries, rankings and factor assessments are generated by AI models from the evidence in the resumes you upload. They are assistive and may be inaccurate, incomplete or out of date. You are responsible for reviewing candidates yourself, for your hiring decisions and for complying with employment, anti-discrimination and data protection law. Moneko does not guarantee that any candidate is suitable, available or accurately described.

Paid plans include access to the REST API for synchronising candidates from your own systems. You may use the API only for your own dataspaces and within the request limits documented in the Service. We may throttle or suspend API access that degrades the Service for others. Breaking changes to the API will be announced in advance where reasonably possible.

• Plan limits and prices are described on the pricing page. Fees are stated in USD, exclude taxes, and are billed monthly in advance unless agreed otherwise.
• Free plans are offered as-is and may be limited, changed or withdrawn. We will give reasonable notice before reducing limits that affect existing content.
• You can cancel a paid plan at any time; it remains active until the end of the paid period and then reverts to the free plan. Fees already paid are non-refundable except where required by law.
• If you exceed your plan’s limits we will contact you; we will not delete content without notice.

We aim to keep the Service available around the clock but do not guarantee uninterrupted operation. Planned maintenance is announced where possible. Support is provided by email at hi@moneko.ai according to your plan. We may modify these Terms; material changes will be announced at least 14 days before they take effect, and continued use after that date constitutes acceptance.

You may stop using the Service and delete your dataspaces at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or if your use creates a security or legal risk — where practical, after notice and an opportunity to cure. Upon termination you may export your Customer Content for 30 days unless the termination was for a serious breach; afterwards it is deleted in line with our Privacy Policy.

The Service, its software, design and the Moneko name and logo are owned by Moneko and its licensors. Except for the licence to Customer Content you grant us and the right to use the Service we grant you, no rights are transferred. Feedback you provide may be used without obligation to you.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and any warranty regarding the accuracy of AI output.

To the extent permitted by law, Moneko’s total liability arising out of or relating to the Service in any twelve-month period is limited to the fees you paid us in that period (or USD 100 if you are on a free plan), and neither party is liable for indirect, incidental, special or consequential damages, loss of profits, loss of data or business interruption. Nothing in these Terms limits liability that cannot be limited by law, including for wilful misconduct or gross negligence.

You will indemnify Moneko against third-party claims arising from Customer Content or your breach of section 4 or 5.

These Terms are governed by the laws of the country in which Moneko is established, without regard to conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the courts of that country, except where mandatory consumer law provides otherwise. Before starting proceedings, both parties agree to try to resolve the dispute informally by contacting hi@moneko.ai.
